Owner of Fragile Apple Watch Comes Out Victorious After Challenging Apple in Court

Given that Apple is one of the biggest names in the tech industry (and now even the wearables segment), a lot of companies and individuals like to take jabs at the company for unfound claims or patent rights. And more often than not, these claims are poorly cited and are founded in nothing, therefore making it easy for Apple to squash these claims. But recently, a man from Wales took Apple to court over his broken Apple Watch display…and won!

Gareth Cross from Aberystwyth, West Wales was in battle with Apple for six-months and came out victorious just this week. Cross originally filed a complaint with Apple after he noted that his Apple Watch display had a crack in it.

“I noticed a tiny 4-5 mm crack on the screen just 10 days after buying it,” Cross told The Daily Mail. “I hadn’t even been doing anything strenuous, just sitting around watching TV. When I got to work the hairline crack had got bigger and bigger so I called Apple up to get it repaired.”

Apparently, Apple was willing to look at the dispute at first, and offered to repair the device if Cross would provide them with photos of the damage. However, upon further investigation, engineers from Apple deemed that the Apple Watch had been damaged from an impact, and thus was not covered under warranty.

This came as a shock to Cross, considering that Apple claims that the Apple Watch is ‘resistant to scratches and impact’.

Oddly enough, after Cross won the court case, Apple retracted their statement that claims that the wearable device is resistant to impact. After Cross noted in his case that he was “prone to knocking things about a bit” and that Apple should be responsible, the company removed the phrase from the product’s description.

The debut of the Apple Watch brought a lot of attention to the wearable technology market. “From 2015 through 2017, smartwatch adoption will have 48 percent growth largely due to Apple popularizing wearables as a lifestyle trend,” noted director Angela McIntyre of the research firm Gartner.

And while it is one of the most talked about Apple products, the company has yet to reveal any numbers detailing the device’s sales. The latest we’ve heard is that the Apple Watch is “seeing record quarterly sales” for Q1, with no number tied to the sales. This is certainly unlike Apple, considering that they are very open about the sales of their signature device, the iPhone. So for now, individuals are led to guesstimate as to the sales of the wearable.
